TERMS AND CONDITIONS

These Terms and Conditions (hereinafter: Terms and Conditions or Terms) govern purchases made through the Charmea.hu online store and the legal relationship between the operator of the online store and the Customer.

The Charmea.hu online store sells products exclusively to natural persons acting as consumers.

Hereinafter referred to as the Service Provider or Seller.


2. Scope and Acceptance of these Terms

These Terms apply to the use of the Charmea.hu online store and to sales contracts concluded through the online store.

Before finalising an order, the Customer has the opportunity to review these Terms. By submitting an order, the Customer accepts the provisions of these Terms.

These Terms are available electronically and may be downloaded, saved and printed.

The language of the contract is Hungarian. An English-language version is provided on the website for information and accessibility purposes. In the event of any discrepancy or question of interpretation, the Hungarian-language version shall prevail to the extent permitted by applicable law.


3. Persons Eligible to Purchase

The Charmea.hu online store provides purchasing opportunities exclusively to consumers.

A consumer is a natural person acting for purposes outside their trade, business, craft, profession or independent occupational activity.

Purchases through the online store are not available to companies, sole proprietors or other persons acting for business or professional purposes.


4. Registration

Registration is not required to make a purchase from Charmea.hu.

Customers may place orders:

  • as registered users; or

  • without registration, as guests.

When registering, the Customer is responsible for ensuring that the information provided is accurate and for maintaining the security of their login credentials.


5. Products

The online store primarily offers jewellery, charms, accessories and other products specified on the relevant product pages.

The essential characteristics, material, size, design and other relevant features of each product are described on its product page.

Product photographs displayed on the website may also serve as illustrations. Due to differences in display settings, the actual colour of a product may differ slightly from the colour displayed on the Customer's screen.

In the case of natural materials, handmade products or products with individual characteristics, minor differences in shape, colour or pattern may occur where such differences result from the nature of the product.


6. Prices

All prices displayed on Charmea.hu are gross consumer prices and include the applicable value added tax (VAT).

Product prices do not include delivery charges unless expressly stated otherwise in connection with a particular offer.

The applicable delivery charge is clearly displayed during checkout before the order is submitted.

Charmea.hu does not provide a general free-delivery threshold based on the value of an order.

The Seller reserves the right to change product prices. Price changes do not affect contracts already concluded and confirmed.

If an obviously incorrect price is displayed – for example, due to a technical error, a price of HUF 0 or a price clearly inconsistent with the normal value of the product – the Seller may offer to fulfil the order at the correct price. The Customer is not obliged to maintain the order at the corrected price.


7. Ordering Process

The Customer may add the selected products to the shopping cart.

The contents of the shopping cart may be modified before the order is finalised, including changing quantities or removing products.

During checkout, the Customer provides the information necessary to fulfil the order, selects an available delivery and payment method, and has the opportunity to review the order summary.

Submitting an order entails an obligation to pay.

Before submitting the order, the Customer is responsible for checking the information provided and the contents of the order.


8. Conclusion of the Contract

An order submitted by the Customer constitutes an offer to purchase made to the Seller.

The system may automatically send an electronic acknowledgement confirming receipt of the order. An automatic acknowledgement confirming receipt of the order does not necessarily constitute acceptance of the Customer's offer.

The contract is concluded when the Seller expressly accepts the order or sends a confirmation regarding its processing or fulfilment from which acceptance of the Customer's offer can clearly be established.

If an ordered product is unavailable, the Seller will inform the Customer accordingly. If payment has already been made, the amount paid for any product that cannot be supplied will be refunded.


9. Payment Methods

The following payment methods are available on Charmea.hu.

9.1. Online Card Payment – Stripe

Customers may pay for their orders online using a payment card.

Online card payments are technically processed using the Stripe payment service.

Payment card details are processed through the payment provider's secure system. Charmea.hu does not store the Customer's complete payment card details.

Following successful payment, processing of the order may begin.

9.2. Cash on Delivery

Where available for the selected delivery method, the Customer may pay for the order by cash on delivery.

An additional cash-on-delivery fee may apply. The exact amount of any such fee will be displayed before the order is submitted.


10. Delivery

Charmea.hu delivers exclusively within Hungary.

Personal collection is not available.

Available delivery methods may include:

  • DPD courier service,

  • MPL,

  • FOXPOST.

The delivery methods actually available for a particular order, together with their charges and any available delivery or collection options, are displayed during checkout.

The Seller does not provide a general order-value-based free-delivery threshold.


11. Delivery and Fulfilment Times

The expected delivery time for products is displayed on the website, relevant product page or during the ordering process.

Where identified as an estimated delivery time, the displayed delivery period is indicative.

The Seller will fulfil orders without undue delay.

If fulfilment of an order is expected to be significantly delayed, the Seller will, where possible, inform the Customer.


12. Receipt of the Parcel

The Customer is responsible for providing delivery information that allows the parcel to be delivered correctly.

If visible external damage to the parcel is apparent upon delivery, the Customer is advised to report this to the courier and, where possible, document the damage.

Failure to inspect the parcel in the presence of the courier or to have a damage report prepared does not, in itself, result in the loss of the Customer's statutory warranty or other consumer rights.


13. Right of Withdrawal

In the case of a distance contract, the consumer generally has the right to withdraw from the contract within 14 days without giving any reason.

In the case of a sales contract, the withdrawal period generally expires 14 days after the day on which the consumer, or a third party other than the carrier and indicated by the consumer, acquires physical possession of the goods.

Where multiple products are delivered separately, the applicable statutory rules determine the beginning of the withdrawal period.

The consumer may also exercise the right of withdrawal before taking physical possession of the product.


14. Exercising the Right of Withdrawal

The Customer may notify the Seller of their decision to withdraw from the contract by means of a clear and unambiguous statement.

The Customer may also use the Model Withdrawal Form available on Charmea.hu, although use of the model form is not mandatory.

The withdrawal deadline is met if the consumer sends the withdrawal statement before the expiry of the 14-day withdrawal period.

Electronic Withdrawal

Where required by applicable law, Charmea.hu provides an electronic withdrawal function on the website through which consumers may submit their withdrawal during the withdrawal period.

Receipt of an electronic withdrawal statement will be acknowledged by the Seller in accordance with applicable law.


15. Returning Products Following Withdrawal

Following withdrawal, the Customer must return or hand over the product to the Seller without undue delay and in any event no later than 14 days after communicating the decision to withdraw.

The direct cost of returning the product is borne by the consumer unless the Seller expressly agrees to bear such cost or applicable law provides otherwise.

The absence of the original product packaging does not, in itself, exclude the consumer's right of withdrawal.


16. Refunds Following Withdrawal

In the event of a valid withdrawal, the Seller will reimburse the payments received from the consumer, including the cost of delivery, subject to the conditions and limitations laid down by applicable law.

If the consumer expressly chose a type of delivery other than the least expensive standard delivery offered by the Seller, the Seller is not required to reimburse the additional costs resulting from that choice.

The refund will be made without undue delay and no later than 14 days after the Seller is informed of the consumer's decision to withdraw from the contract.

The Seller may withhold reimbursement until the goods have been returned or until the consumer has provided evidence that the goods have been sent back, whichever occurs first.

Unless the consumer expressly agrees otherwise, reimbursement will be made using the same means of payment as used for the original transaction, provided that the consumer does not incur any additional fees as a result.


17. Diminished Value

The consumer is liable only for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Using a product beyond what is reasonably necessary to inspect and test it may therefore result in liability for diminished value.


18. Exceptions to the Right of Withdrawal

The consumer does not have a right of withdrawal in cases where an exception is provided for by applicable law.

This may include, in particular, goods that are made to the consumer's specifications, are not prefabricated, or are clearly personalised.

If Charmea.hu offers individually engraved, personalised, made-to-order or otherwise clearly customised jewellery, the relevant product page may specifically inform the Customer before purchase where the statutory right of withdrawal does not apply.

Merely selecting a size, colour or another predefined product variation from available stock does not necessarily make a product personalised.


19. Statutory Warranty for Defective Performance

In the event of defective performance, the Customer may exercise statutory warranty rights against the Seller in accordance with the Hungarian Civil Code and other applicable consumer protection legislation.

Subject to the conditions laid down by law, the consumer may primarily request repair or replacement unless the chosen remedy is impossible or would impose disproportionate additional costs.

Where the statutory conditions are met, the consumer may request an appropriate reduction in the price or terminate the contract.

Statutory warranty rights may be exercised within the periods prescribed by applicable law.


20. Product Warranty

In the event of a defect in movable goods, the consumer may, under the conditions specified by applicable law, exercise product warranty rights against the manufacturer of the product.

Under a product warranty claim, the consumer may request repair or replacement of the defective product in accordance with applicable law.

The consumer may not obtain duplicate remedies for the same defect simultaneously under both statutory warranty and product warranty rules.


21. Commercial and Mandatory Guarantee

Where a product sold by Charmea.hu is subject to a mandatory guarantee under applicable law, the provisions of the legislation in force at the relevant time shall apply.

The Seller or manufacturer may also provide a voluntary commercial guarantee in addition to any statutory guarantee. The terms of such a guarantee will be stated on the relevant product page or in the applicable guarantee documentation.

A guarantee does not affect the consumer's statutory warranty or product warranty rights.


22. Complaints

Customers may submit complaints relating to products, orders or the Seller's activities using the following contact details:

The Seller handles consumer complaints in accordance with applicable law.

Written complaints will be investigated and answered in writing within the period prescribed by law.

If a complaint is rejected, the Seller will provide information about the available dispute resolution options in accordance with applicable requirements.


23. Conciliation Board

If a consumer dispute between the Customer and the Seller cannot be resolved through direct negotiation, the consumer may apply to a conciliation board.

The purpose of conciliation proceedings is to resolve consumer disputes between consumers and businesses outside court proceedings.

The Seller is required to cooperate in conciliation proceedings in accordance with applicable law.

The consumer may apply to the competent conciliation board in accordance with the applicable statutory provisions.


24. Consumer Protection Authority

If the consumer believes that their consumer protection rights have been infringed, they may contact the competent consumer protection authority.

Consumer protection authority functions are performed by the authorities designated under applicable legislation.

For the resolution of individual consumer disputes, Customers are encouraged to contact the Seller directly first and, where appropriate, use the conciliation board procedure.


25. Data Protection

Detailed information regarding the processing of Customers' personal data is provided in the separate Privacy Policy available on Charmea.hu.

The Seller processes personal data necessary for fulfilling orders in accordance with applicable data protection legislation.

Information necessary for delivery may be transferred to the courier or logistics provider selected by the Customer.


26. Intellectual Property

Content available on Charmea.hu – including, in particular, texts, graphics, photographs, product descriptions, logos and the individual design of the website – may be protected by copyright or other intellectual property rights.

Unauthorised copying, reproduction, distribution or commercial use of such content is prohibited unless permitted by applicable law or authorised by the relevant rights holder.


27. Technical Errors and Availability

The Seller endeavours to ensure the continuous and error-free operation of the online store. However, the service may temporarily be restricted or unavailable due to technical faults, maintenance or circumstances beyond the Seller's control.

Before finalising an order, the Customer is responsible for checking its contents, including the selected products, quantities, delivery details and total amount payable.


28. Liability

To the extent permitted by applicable law, the Seller is not liable for losses caused by circumstances outside its reasonable control that could not reasonably have been foreseen or avoided.

Nothing in these Terms excludes or limits any liability of the Seller that cannot lawfully be excluded or limited under mandatory consumer protection legislation.


29. Amendments to these Terms

The Seller reserves the right to amend these Terms with effect for the future.

The amended Terms apply to orders submitted after the amended version has been published on the website.

Amendments do not retroactively modify the terms applicable to contracts concluded before the amendment entered into force.


30. Governing Law

These Terms and contracts concluded through the Charmea.hu online store are governed by Hungarian law, including in particular the Hungarian Civil Code and the legislation applicable to electronic commerce, consumer protection, consumer contracts, statutory warranties, guarantees and withdrawal rights.

This choice of law does not deprive consumers of any mandatory protection afforded to them by provisions of law from which the parties may not derogate by agreement.


31. Final Provisions

If any provision of these Terms is found to be invalid or unenforceable, this will not automatically affect the validity or enforceability of the remaining provisions, unless otherwise required by applicable law.

Matters not expressly regulated by these Terms are governed by the applicable Hungarian and European Union legislation in force.
